Ação de ressarcimento de valores. Sentença de procedência. Apelo da ré. Qualquer um dos credores solidários pode ajuizar demanda para pleitear o recebimento da quantia integral. Solidariedade ativa que não enseja litisconsórcio necessário. Financiamento com garantia de&nbsp;</span>alienação fiduciária<span style="font-size:9pt;">&nbsp;de bem imóvel. Inadimplência. Consolidação da propriedade em favor do credor fiduciário. Primeiro e segundo&nbsp;</span>leilões negativos<span style="font-size:9pt;">. Imóvel vendido em terceiro leilão por valor superior ao da dívida.&nbsp;</span><b>Saldo</b><b><span style="font-size:9pt;">&nbsp;remanescente após a quitação do débito em aberto que deve ser devolvido ao devedor</span></b><span style="font-size:9pt;">, sob pena de configuração de enriquecimento ilícito. Art. 27, § 4º, da Lei 9.514/97. Recurso desprovido.</span></p><p style="text-align:justify;margin-left:106.35pt;"><span style="font-size:9pt;">&nbsp;</span></p><p style="text-align:justify;">Como se pode observar desta decisão, o Banco foi obrigado a devolver o valor do lucro que obteve na venda do imóvel que adquiriu pelo preço da dívida. </p><p style="text-align:justify;">&nbsp;</p><p style="text-align:justify;"><b>O Caso em Questão</b></p><p style="text-align:justify;">O caso analisado envolvia um financiamento com garantia de alienação fiduciária de bem imóvel, onde, após a inadimplência do devedor, ocorreu a consolidação da propriedade em favor do credor fiduciário. Tanto o primeiro quanto o segundo leilões foram negativos. Com isto, o imóvel passou a ser de propriedade do Banco, que, posteriormente, em uma operação privada, vendeu por um valor superior ao da dívida. O TJSP manteve a sentença de procedência que determinou que o saldo remanescente, após a quitação do débito, deve ser devolvido ao devedor, sob pena de enriquecimento ilícito, conforme disposto no art. 27, § 4º, da Lei 9.514/97.</p><p style="text-align:justify;">&nbsp;</p><p style="text-align:justify;"><b>O Entendimento das Entidades Financeiras</b></p><p style="text-align:justify;">Muitas entidades financeiras argumentam que, em casos em que os primeiros leilões são negativos, elas não são obrigadas a devolver qualquer saldo remanescente ao devedor. Essa perspectiva tem sido criticada por resultar em enriquecimento sem causa, contrariando princípios fundamentais do direito civil brasileiro.</p><p style="text-align:justify;">&nbsp;</p><p style="text-align:justify;"><b>CONCLUSÃO</b></p><p style="text-align:justify;">A decisão do TJSP reflete um posicionamento que busca equilibrar os interesses dos credores e dos devedores, promovendo justiça e prevenindo o enriquecimento ilícito. A alienação fiduciária, por sua natureza, visa garantir o cumprimento das obrigações do devedor, não a obtenção de lucro indevido pelo credor. O TJSP corretamente aplicou o art. 27, § 4º, da Lei 9.514/97, ao determinar que o saldo remanescente deve ser devolvido ao devedor. Esse dispositivo legal visa garantir que o credor não se beneficie além do que lhe é devido, evitando o enriquecimento ilícito.</p><p style="text-align:justify;">&nbsp;</p></div></div></div>
